Professional Experience

Mr. Seibert is Of Counsel in the Albuquerque office and practices in the firm’s Business Department. He has had a varied commercial practice in Albuquerque since 1983, primarily involving commercial real estate, real estate finance, real estate leasing, real estate development, business transactions, real estate litigation, and general business and corporate law. Mr. Seibert has represented, among others:

  • regional real estate developers, project operators and investors
  • financial institutions;
  • closely-held/family corporations;
  • business buyers, sellers and franchisees;
  • non-profit institutions;
  • individuals; and
  • issuers and users of state government bonds;

with responsibility for due diligence, negotiation, documentation and closing of transactions in New Mexico and surrounding states, including vacant land and project acquisitions, sales and exchanges; construction, permanent and equity financing; joint venture agreements; complex lease negotiation and drafting matters, including ground leases, retail and office leases, and build-to-suit leases; lease administration, interpretation, amendment, enforcement and workouts; condominiums; easements; City-supported affordable housing programs; and development and implementation of protective covenants, as well as litigation involving property access, liens, leases, easements and mortgages, among other matters.

He also has experience providing clients general advice on tort and environmental liability; business start-up, capitalization, structural and governance issues; business acquisitions and sales; business strategy and planning; state and federal tax issues; local government relations; dispute avoidance and resolution; insurance and risk management; ethical issues; and technology development and exploitation (including licenses, R & D agreements, non-disclosure agreements, commercialization agreements, and research subcontract and teaming agreements).
