New Group Forms to Fight for File Incentives and Grow Film Industry in New Mexico

“Protect the Film Industry and Jobs,” says group

A new film and digital media association has formed in New Mexico to expand the film business and protect this state’s film incentives that may come under attack in the next session of the legislature, said assocation spokesperson Gina Constant, an attorney at the Rodey law firm.

The new association, the New Mexico Entertainment & Digital Industry Association, or NMEDIAsm, has stated its purpose as protecting and expanding the film infrastructure and promoting the growth of film and digital media industries in New Mexico.  The first stated goal for NMEDIAsm is to protect the state-sponsored film incentive programs credited with bringing hundreds of films to this state over the past eight years.

“What’s at stake here is the entire New Mexico film industry,” said Gina Constant, spokesperson for the new board of directors.  “We have made all this investment in the film business and if we lose the film incentives it could all slide backwards very quickly.”

New Mexico has made good progress in the past decade in creating a film industry.  Recently, MovieMaker magazine ranked Albuquerque as the top city in the U.S. in which to be an independent moviemaker.  The state has seen several high-profile movies being shot around the state, including Crazy Heart, Terminator 4, The Book of Eli, as well as television shows out of the Albuquerque and I-25 Studios.  Much of the film activity comes from the state’s film incentive program, which gives a 25% rebate on NM goods and services.  However, there are 44 states that give some kind of film incentives, and of those 20 are higher than New Mexico already.

               “We have to stay competitive to keep our film business thriving,” said Jason Lott, a board member who also oversees leasing at Mesa del Sol.  “We have created an industry in this state and we don’t want our students that come out of film programs to have to move to LA.”

               Many of our high schools and colleges have implemented programs to provide students with film experience, in association with the film industry, and those students are graduating into the local film scene.  If the state kills the incentives, the films may dry up and go elsewhere, leaving no films for the students to work on, said association members.

“We see first-hand the high paying jobs that are being created and we want that trend to continue,” said Constant.  “We want the students from these programs to be able to stay here to practice their trade after they graduate, rather than continue the brain drain of our young people.”

The assocation will work to educate members of the legislature about the critical need to continue the film incentives during the next session of the legislature, which starts in January.  In addition, the association wants to expand the film infrastructure to continue making an industry here, not just films coming and going.

Rodey Lawyers Listed in Super Lawyers-Corporate Counsel Edition

Jeff Lowry, a partner in the firm, focuses his practice on employment and labor law.  He has tried numerous employment cases in both state and federal court, and has represented clients before the United States Court of Appeals for the Tenth Circuit and the New Mexico Court of Appeals.

Julie Neerken, also a partner in the firm, specializes in the area of employee benefits.

Rodey Lawyer Graduates from Leadership Albuquerque

Attorney Gina Constant has graduated from the Greater Albuquerque Chamber of Commerce’s Leadership Albuquerque program.  In connection with the program, Ms. Constant and her project team created a short video about green filmmaking. The video can be seen on the website of the Albuquerque Film Office.

Gina is an associate with the Rodey Law Firm and a registered patent attorney with the US Patent and Trademark Office.  She practices in the firm’s Business Department primarily in the areas of entertainment law, intellectual property, specifically, patent, copyright and trademark law.

Rodey Attorney to Receive Award from the National Client Protection Organization

Charles J. Vigil will receive the prestigious Isaac Hecht Award from the National Client Protection Organization (NCPO).  Mr. Vigil was unanimously selected on behalf of the State Bar of New Mexico to receive the 2010 Hecht Award.  The Hecht Award recognizes individuals and professional organizations that have demonstrated “excellence in the field of law client protection”.  The Hecht Award was established in memory of attorney Isaac Hecht of Maryland for his lifetime professional service to the legal profession and his advocacy of Law Client Protection Programs throughout North America.

Rodey Attorney Receives Specialization Certification

Glenn Beard has been certified as a Certified Specialist in the area of Employment and Labor Law by the New Mexico Board of Legal Specialization.  Mr. Beard, an associate with the Rodey Law Firm, is a member of the firm’s professional liability practice group.  His practice focuses on the defense of hospitals, physicians and other health care providers in medical malpractice actions.  Mr. Beard also has extensive experience representing employers in all aspects of labor and employment law.

Amanda C. Sanchez has been elected to the Board of Directors of the Domestic Violence Resource Center.  Ms. Sanchez is an associate at the Rodey Law Firm and a member of the firm’s Business Department. Ms. Sanchez was awarded her law degree cum laude from the University of New Mexico School of Law in 2005. 

The Domestic Violence Resource Center provides service assessment, support services, counseling, education and training, life and social skills development, crisis intervention and legal services for adults and children who are victims of domestic violence. 

Rodey Attorney Selected for Labor-Management Relations Board

Thomas L. Stahl has been selected by the Mayor of Albuquerque to serve a two-year term on the City’s Labor-Management Relations Board.  An attorney with the Rodey Law Firm and the leader of Rodey’s Labor and Employment Law Section, Mr. Stahl’s professional experience and current practice are in employment and labor law, particularly the defense of employers in a wide range of employment actions, including claims of age, race, religion, sex and disability discrimination, sexual harassment, retaliatory discharge, breach of contract and defamation. Mr. Stahl also works with employers providing employer counseling and training on the legal aspects of human resource issues.  Mr. Stahl is certified by the New Mexico Board of Legal Specialization as a specialist in Employment and Labor Law.

John P. Salazar has been elected to the Board of Directors of the Federal Home Loan Bank of Dallas.  Mr. Salazar was elected by the Bank’s at-large membership to fill a two-year term.  An attorney with the Rodey Law Firm, his professional experience and current practice are in real estate, land use and development law.

Catherine T. Goldberg has been elected to the Board of Directors of Albuquerque Economic Development.  Ms. Goldberg is a partner and shareholder in the Rodey Law Firm. (Jack) Burton has been selected as a Fellow of the American Bar Foundation.  Membership in the Fellows is limited to one-third of one percent of lawyers licensed to practice in each jurisdiction.  Mr. Burton is a director and shareholder in the Rodey Law Firm, and the leader of the firm’s Land Use and Real Estate Practice Group.  Mr. Burton is also a Uniform Law Commissioner.  He received his law degree from the Harvard Law School in 1968.

Rodey Attorney Receives ACLU’s Cooperating Attorney of the Year Award

At the Bill of Rights Celebration on Saturday, September 26th, the ACLU of New Mexico presented Charles (Kip) Purcell with their Cooperating Attorney of the Year Award. The award is given each year to a New Mexico attorney who assists the ACLU with litigation and/or other activities. 

A graduate of Harvard Law School, Mr. Purcell is a partner with the Rodey Law Firm, and a member of the firm’s Health Law practice group.  His practice focuses on tort litigation, insurance litigation, media law, personal injury, products liability, medical and legal malpractice, civil rights litigation, appellate litigation, and general litigation.  He is President of the New Mexico Foundation for Open Government and Vice-President of Equal Access to Justice.

On May 29, 2009, the New Mexico Court of Appeals denied new trial and affirmed the verdict for defendants in Kilgore vs. Fuji Heavy Industries Ltd., et al., N.M. Ct. App. No. 27,470, 5/29/09).
