Representative Matters: Land Use
- Representing Diamond Tail Estates, a large scale residential development near Placitas, New Mexico, in the zoning, development, and marketing of its residential subdivisions.
- Representing Lovelace Medical Center in an agreement among Lovelace Medical Center, the City of Albuquerque, and Albuquerque Public Schools regarding the operational aspects and use of a stretch of street between the Lovelace Medical Center and an elementary school.
- Representing Coast Range Investments, Inc. in its development located in Belen, New Mexico.
- Representing the University of New Mexico in the development of its South Campus, including issues pertaining to possible amendments to the Master Plan and rezoning.
- Represented Andalucia Development Co., Inc. in matters relating to impact fees imposed by the City of Albuquerque.
- Represented a land owner in obtaining zoning of a large parcel of vacant land for a regional shopping center on Albuquerque's west side. The land was located in the vicinity of a rural, residentially developed area. We were successful despite strenuous neighborhood opposition.
- Represented Prudential Insurance Company of America and Winrock Shopping Center in obtaining land use approvals and in related litigation pertaining to the redevelopment of the shopping center.
- Represented Prudential Insurance Company of America and Winrock Shopping Center in successful negotiations with the city, state, and adjoining land owners to construct a freeway interchange and develop adjoining roadways. The result was efficient and positive movement of traffic to and from the shopping center.
- Represented Prudential Insurance Company of America and Winrock Shopping Center in their objection to a major Albuquerque developer wanting to put a road through Winrock Shopping Center's property to provide access to his adjoining property. By working with the City Council and several other city departments, we successfully negotiated placement of the road to the satisfaction of all parties.
- Represented the University of New Mexico in condemnation proceedings in which the City of Albuquerque sought to acquire additional land for airport expansion.
- Represented Black Hills Corporation, Inc. in connection with vested rights relating to zoning laws.
- Represented Mesa Verde Development in a dispute with Homeowners Association and others relating to the number of dwelling units allowed per acre.
