Estate Planning and Probate
Rodey Firm provides a variety of estate
planning and probate services, including representing
clients in trust and estate litigation. We counsel
with families and prepare routine but necessary estate
planning documents such as wills, revocable trusts,
powers of attorney and powers of attorney for healthcare.
For wealthier clients, we work with them to prepare
wills and trusts which make use of statutory provisions
to minimize the impact of estate taxes on large estates.
New Mexico has adopted the Uniform Probate Code so
that the probate administration of estates has been
simplified. We regularly represent clients in estate
administration and out of state clients who need
to clear title to New Mexico property held in the
estates of non-resident decedents. We have recently
handled a large intestate estate administration involving
five generations of a New Mexico family and more
than one hundred heirs, which presented a number
of unusual and complex issues. Rodey's estate planning
and probate attorneys also handle litigation involving
trusts and estates as well as litigation and other
disputes concerning guardianship and conservatorship
proceedings.
We are involved in drafting
and commenting on statutes dealing with trust and
probate matters. One of our directors is a Uniform
Laws Commissioner for New Mexico, and others are members
of the New Mexico Estate Planning Council and the
Taxation Section of the State Bar. Among our attorneys
are Fellows of the American College of Trust and Estate
Counsel, the American College of Real Estate Lawyers
and the American College of Mortgage Attorneys.
